Aggressive Defense Against DWI and DUI Charges
If you have been charged with driving while intoxicated, you could be facing serious consequences. David Haber has handled thousands of DWI cases as a prosecutor and defense attorney. Accordingly he understands the factors considered by the prosecution when negotiating or resolving DWI cases. Located in Garden City, we defend clients throughout Long Island, Suffolk County, Nassau County including the five Boroughs- Bronx, Queens, Brooklyn, Manhattan and Staten Island who have been charged with DWI.
Understanding DWI and DUI Charges
It is important to understand what charges you are facing if you have been arrested for drinking and driving. If your blood alcohol content (BAC) is .08 or higher, you are probably facing charges of driving while intoxicated (DWI). If your BAC is .18 or higher, the charges are probably aggravated driving while intoxicated. A BAC of .05-.07 will likely result in a charge for driving while ability impaired (DWAI).
Restoration of Your Drivers License
An arrest for driving while intoxicated will generally result in the suspension of your license. In certain cases you can request a hardship license hearing to obtain permission to drive to school or work. As time of the essence to obtain a hardship license, it is important to contact a lawyer as soon as possible. Our attorney works to help clients restore their licenses. If your license has been suspended, there are two types of licenses you may be eligible for:
- Hardship license: If granted a hardship license, you will be able to drive to school or work.
- Conditional license: Allows more freedom to drive than a hardship license.
Consequences of a Conviction are Serious
The consequences of being convicted of a DWI charge can be severe. With a conviction you face penalties such as fines, license suspension or revocation, jail time, ignition interlock device, probation or treatment. The penalties are even higher for:
- A second conviction in ten years
- Vehicular assault or manslaughter
- Underage drinking and driving
